General terms and conditions of sale of our products and artworks
This page contains the General Terms and Conditions of Sale for the items offered on the www.lorientalphotography.com website. All items are sold directly and exclusively by Pierre-Emmanuel STAEBLER aka Loriental Photography, a French professional artist, photographer and educator.
Customers purchasing any item agree to abide by the present Terms of Sales and unreservedly accept all of them.
We reserve the right to update, change or replace any part of these Terms of Sales based on the development of its business, on market changes, and to comply with any changes in Law, by posting updates and/or changes to our website. Updates and changes will be published regularly on the website and will have immediate validity. It is your responsibility to check this page periodically for changes.

Limited Edition prints and Artist’s Proofs are signed and numbered original artworks created under our supervision and as such are considered as “oeuvre d’art” under French Law.
All displayed prices are in EURO and include VAT. All products are sent to you from France, so if you are shopping from outside the EU, please note that local VAT and custom fees may apply.
Prices include delivery charges worldwide.
We retain the right to change prices at any time.
To complete the purchase of one or more items available on the web site www.lorientalphotography.com, you need to add your desired product(s) to the cart, and proceed with the checkout using one of the available payment methods.
The order form contains a summary of our conditions of purchase, including the price and payment method, as well as the main features of the product ordered.
By submitting the order form, you declare that you know and unconditionally accept the General Terms and Conditions of Sale listed here, and you also confirm that you know the additional information contained on our website, including any external references via web links.
All of our orders are processed through Stripe or Paypal secure online payment systems. Both Stripe and Paypal use an authenticated payment server that encrypts all your card information with SSL (Secure Socket Layer) protocol. This means that your information cannot be read, all transactions being processed without sharing your financial details.
We accept all major International credit cards through Stripe or Paypal.
The payment is processed at time of purchase.
When placing an order, the User must indicate the appropriate delivery address. We cannot accept liability for any failure to deliver ordered Products due to incorrect or incomplete delivery address. Products are shipped to the address indicated during the order process.
The delivery is to be made within two (2) to four (4) weeks in France, three (3) to five (5) weeks in European Union, four (4) to (6) weeks in the rest of the World. Delivery times mentioned are indicative and may vary depending on the destination country.
Once the package leaves our office to the delivery address indicated by the User when ordering Product(s), he or she receives a shipment confirmation e-mail from us with a tracking number which will allow the User to check the status of the parcel on the carrier’s website. Each delivery is deemed as completed once it is made available to the customer by the transporter.
In case of absence upon delivery at the address specified by the User, a note of passage will be left up by the carrier to the mailbox, offering to the User to organise a redelivery of the parcel by choosing a desired time and date or another address on the carrier’s website (the User will need his tracking number for this kind of arrangement) or offering the User to collect the parcel at the post office within 15 (fifteen) days. If not collected in a timely manner by the User, the product will be returned to us. In such case, we will contact you regarding new shipment options. Regardless, you will be charged all costs related to a new shipment.
If, 7 (seven) business days after shipment of the package, the customer has not received any information about his order, he must contact the post office that is closest to the location of delivery. If the post office or if the delivery tracking system offered on the Internet sites of our carrier is not able to locate the package, you must then contact us by email so that we can make enquiries with the postal service. The timeframes for a definitive response from the postal service may vary from one to three weeks starting from the time of acknowledgement of the situation by us. If the package is found, it is sent it the customer if the procedure of receipt follows its normal course (delivery of the package or notice of passage). If the package is declared as lost (the definitive response is often provided within the maximal timeframe, or three weeks), we then notify the customer and immediately reimburses the customer for the package (products and shipping charges).
We are not liable for breach of contract arising out of circumstances beyond our control such as disruption or strikes of postal services or transport/communication means. Circumstances beyond our control include but are not limited to: war, riot, fire, strikes, accidents, or blocking of the means of transport or supply.
In any event, the on-time delivery of our products can only take place if our buyers are up-to-date with their obligations to us.
The User is encouraged to check the parcel methodically upon its arrival. If a parcel arrives obviously damaged, the User has the right to refuse the order at the time of delivery. If the User decides to accept a damaged parcel, the User’s reservations must be written on the delivery note in the presence of the carrier in order to claim compensation.
If the products you received are damaged or defective, please document all damages, including the outside packaging and include them in an email to us. Without clear photographic documentation of both product and packaging, we will not be able to issue a refund or replace your product. We ask you to promptly inform us by e-mail to firstname.lastname@example.org within 72 hours of delivery so that we can immediately manage the problem and work out a mutually satisfactory solution.
Damaged or defective products are to be returned within seven (7) calendar days from the date of delivery. Return requests received outside the stated return period will not be accepted. The Product must be returned in original condition, in its original packaging (including all accompanying certificates received with the order) and shipped in conditions identical to those of the sending. The return costs will be borne in full by the User. The costs in case of loss or damage of the goods, during the return process, will also be at your expense. We reserve the right to refuse any returns which do not comply with the above criteria. In particular, we disclaim all liability in respect of a parcel returned by the buyer without tracking. No refund will be given if the item is not returned to us in full, in its original condition, and packaged in the original material. In this case, you can still request at your expense that the goods are shipped back to you in the state in which they were returned. Otherwise, we may keep the goods, in addition to the sum initially paid for their purchase.
When returned goods are received in accordance to the above criteria, we will either refund the value of your order or replace your product depending on your preference. User shall be refunded or replacement shall be sent as soon as possible and no later than 30 days following the date on which we receive the returned goods. Any reimbursement shall be made by any means of payment except cash.
In accordance with the relevant legal provisions, in the context of a purchase from a professional Vendor established within the European Economic Area (member countries of the European Union as well as Iceland, Norway and Liechtenstein), the buyer, if he is a citizen of said Area himself, has a period of 14 days from the receipt of the Product(s) he ordered to exercise, in relation with the said Vendor, his right of withdrawal, without having to justify his reasons or to pay a penalty. If the buyer is not a national of this area himself, this right of withdrawal is not applicable.
It is stipulated that the aforementioned legal right of retraction will not be applicable by the Client in cases where the Work(s) bought by the Client are custom-made or customised at his specific request. Our Open Edition fine art prints, Limited Edition fine art prints and Special Edition wall art are all custom-made to order, thus they are not eligible for any returns or refund except for damage caused by shipping as mentioned in the previous section of our Terms of Sales, so unless your print arrives damaged or defective, we can’t accept returns or offer a refund. Our Open Edition fine art prints, Limited Edition fine art prints and Special Edition wall art are all sales are final.
All the artworks offered for sale on the website are protected by the French Code of Intellectual Property (Code de Propriété Intellectuelle) and the international legislation on copyright and intellectual property. As such, all materials are subject to the Laws protecting ownership of copyright. No copyright license, or any right other than that of owning an artwork for personal and private use is granted to any buyer or third party with regard to intellectual property rights. The reproduction of any artwork is authorized only for exclusively informational purposes or for personal and private use. Any reproduction and any use of copyright materials used for any other purpose without explicit and prior permission is strictly forbidden.. Duplication, processing, distribution, or any form of commercialization of such material beyond the scope of the copyright law shall require the prior written consent of its respective author or creator.
The customer acknowledges that any issue related to the items offered for sale on this website is governed by French law. In the event of any dispute, French courts will have sole jurisdiction unless information to the contrary is given in the general conditions.
